SHENZHEN, China, Jan. 7, 2021 – EDAN Instruments, Inc., a Shenzhen-based healthcare company that invented the Chinese first POCT Blood Gas and Chemistry System, announced that The Supreme People’s Court of The People’s Republic of China has found that Wondfo infringes four EDAN patents. The four patents originally applied by Wondfo, are now sentenced the application rights belongs to EDAN.

The decision is based on the fact that two inventors of these four patents, Yuanqiang Lai and Bin Yang, were EDAN’s former employees. The two directly worked on the invitation after left EDAN less than a year later. Lai and Yang joined EDAN as POCT structure engineers in 2010, and they quit in June 2015. Wondfo filed four patents on blood gas analyzer and its cartridge with the two named as inventors.

According to the Supreme Court, Wondfo does not have blood gas analyzer related patents or invents, or the R&D team before Lai and Yang joined the company. Lai and Yang have profound contributions to these four patents, and the invents are closely related to their work at EDAN. By law, the inventions and creations made by former employees should belong to its former company, if one leverages their ideas formed in the former company and left the company less a year.
